Maternity Leave Return to Work Letter - for employers

Employees who have had a child and are on maternity leave have the right to return to work.

Return to work can be at any time (during Ordinary Maternity Leave (OML), during Additional Maternity Leave (AML), end OML, or end AML).

However, depending on when an employee wishes to return to work affects whether they have the right to return to the same job (or an alternative role) and how many weeks notice of their return they must give to their employer.

Employee Returning to Work after maternity leave

Use this letter to confirm an employees decision to return to work after maternity leave during, end or after OML and during or end AML (we also have another letter to confirm an employees non-return).

This letter includes easy to understand paragraphs to choose from to confirm details about an employee's return to work, including:

  • early return (return prior to end 52 week period).
  • return during OML or AML (return during first or second 26 week period).
  • return end OML or AML (return end 26 weeks or end 52 weeks).
  • notice of return for accepting or declining notice provided (8 weeks required).
  • job upon return and whether it will be the same job or an alterntive role.
  • flexible working requests to confirm a request & to discuss the possibility of alternative work arrangements with an employee.

This letter also includes employer notes on UK Maternity rights, and takes account of recent maternity regulation changes in relation to keeping in touch with employees, attending work and training days (without affecting SMP or leave), extended maternity leave, contractual benefits during AML, notice of early return and important maternity dates.
