Exit, Resignation and Retirement

Documenting employment terminations is just as important as documenting the commencement of employment. It is essential for an employer to note why, when and how employment was terminated if they are to avoid claims of constructive or unfair dismissal.

Gain valuable insight from employees that leave with Online Exit Interviews.

Together with this, in order to comply with the Data Protection Act 1998, employment data retained on an employee and supplied to another employer must be done with an employees express consent. Such data must also have been obtained in a fair and lawful manner, and must not be held for longer than necessary (this includes the collection, retention and disclosure of employee references).

It is therefore wise for an employer to obtain an employee's consent and agreement to what work reference details will be provided to prospective employers, prior to an employee leaving the company. Together with this all information gathered as part an employment termination process should also be treated as confidential.
