Invitation to a Formal Disciplinary Hearing

This standard letter provides managers with a quick and easy way to invite an employee to attend a formal discipline hearing.

It is important to formally invite an employee to a disciplinary hearing and thereby give you the opportunity to address performance problems, inappropriate conduct or behaviour, recurrent issues and record the formal discussions held between an employee and their supervisor or line manager.

This one document can be used for all formal disciplinary hearings (including gross misconduct) and ensures managers adhere to 2009 Discipline and Dismissal Arrangements and Code of Practice when inviting employees to a formal disciplinary hearing by:

  • inviting an employee to a formal discipline hearing
  • confirming the discipline hearing details
  • itemising disciplinary allegations and complaints
  • advising the employee of their right to be accompanied at the disciplinary hearing (failing to do so is in breach of the new Code)
  • informing the employee of other persons who will be present at the disciplinary hearing
  • outlining the consequences of discipline action (including possible dismissal)
  • providing investigatary evidence and policy documentation
  • conveying the serious nature of the matter

This one letter can be used to invite an employee to the following types of discipline hearings:

  • First formal hearing (no previous written warning issued)
  • Second formal hearing (first written warning previously issued)
  • Final formal hearing (final written warning  previously issued)
  • Gross Misconduct hearing (including after a period of suspension)
