Discipline Written Warning (formal)

Two letters for handling common discipline issues can be used for both first written warnings and final written warnings:

  • Letter 1 : confirms discipline warning for performance problem
  • Letter 2 : confirms discipline warning for conduct and behaviour issue

These letters provide managers with a quick and easy way to communicate formal discipline written warnings.

The focus of these two letters is:
1) confirming the disciplinary hearing outcome;
2) conveying the serious nature of the matter; and
3) communicating the next course of formal disciplinary action should things not improve.

In addition, these letters will help you prove you advised your employee of: your concerns; improvements required; and consequences of failing to improve.

In line with the 2009 Discipline and Dismissal Arrangements this letter can be used to clearly inform an employee of a formal written warning and ensures managers:

  • confirm formal disciplinary action has taken place
  • affirm formal disciplinary hearing details
  • convey the formal disciplinary decision reached
  • outline reasons for the discipline decision being taken
  • summarise improvements required, company expectations and timeframe for improvement
  • offer help or assistance to aid improvement
  • specify training an employee needs to complete
  • confirm the duration of the formal written warning
  • advise the formal right of appeal
  • outline the next course of formal disciplinary action should things not improve

If an employee fails to improve and further formal disciplinary action is taken, this letter will help you prove you acted as a reasonable employer and informed the employee of your concerns, gave them an opportunity to improve and advised them of the consequences of not improving.
