Employees have a legal right to appeal against a formal disciplinary decision.
This letter provides managers with a quick and easy way to invite an employee to attend a formal discipline appeal hearing (giving the employee an opportunity to put forward their reasons for appealing a formal discipline warning decision).
This one document can be used for all formal disciplinary appeal hearings (including appealing dismissal) and ensures managers adhere to 2009 Discipline and Dismissal Arrangements when inviting employees to a formal disciplinary appeal hearing by:
- inviting an employee to a formal discipline appeal hearing
- confirming details and purpose of the discipline appeal hearing
- requesting additional information for consideration
- conveying what will happen during the disciplinary appeal hearing
- outlining what will happen if further investigations are necessary (including adjournment)
- advising the employee of their right to be accompanied at the appeal hearing
- informing the employee of other persons who will be present at the appeal hearing
- providing policy documentation
- advising the formal appeal decision is final
